Terms of Service

1. Agreement to Terms

By accessing or using DealFlow ("the Service"), operated by DealFlow ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

DealFlow is an AI-powered wholesale real estate automation platform that provides:

SMS outreach and AI-powered text response automation
AI phone call agent for seller negotiations
Lead management and CRM tools
Deal analysis and property valuation tools
CSV lead import and campaign management

3. No Refund Policy

All sales are final. We do not offer refunds under any circumstances. By subscribing to DealFlow, you acknowledge and agree that all payments are non-refundable. This includes monthly subscription fees, setup fees, and any add-on purchases. You may cancel your subscription at any time, but no refunds will be issued for the current billing period or any prior periods.

4. Subscription & Billing

DealFlow is offered on a monthly subscription basis. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel. You may cancel at any time through your Stripe account or by contacting support@yourdealflow.org. Cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree to use DealFlow only for lawful purposes and in compliance with all applicable federal, state, and local laws, including but not limited to:

The Telephone Consumer Protection Act (TCPA)
CAN-SPAM Act
All applicable telemarketing and do-not-call regulations
A2P 10DLC messaging requirements

You are solely responsible for ensuring your use of the Service complies with all applicable laws. We provide the tools — how you use them is your responsibility.

6. Prohibited Uses

You may not use DealFlow to:

Send messages to numbers on the National Do Not Call Registry without proper exemption
Send harassing, threatening, or deceptive messages
Impersonate another person or entity
Engage in any illegal activity
Resell or sublicense the Service without our written permission
Attempt to reverse engineer, hack, or compromise the Service

7. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

8. Third-Party Services

DealFlow integrates with third-party services including Twilio, Bland.ai, OpenRouter, and RentCast. Your use of these services is subject to their respective terms and conditions. We are not responsible for the availability or performance of third-party services.

9. Limitation of Liability

DealFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the month preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will generate leads, close deals, or produce any specific results. Real estate investing involves risk, and results vary based on market conditions, effort, and other factors outside our control.

11. Indemnification

You agree to indemnify and hold harmless DealFlow, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.

12. Data & Privacy

We collect and process data necessary to provide the Service, including lead information, conversation logs, and account details. We do not sell your data to third parties. For more information, see our Privacy Policy.

13. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any reason at our sole discretion. Upon termination, your access to the Service will cease immediately. No refunds will be issued upon termination.

14. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict of law provisions.
